The terms “we,” “us,” and “our” refer to Vintage Floof. Vintage Floof operates this website and online store, including all related information, content, features, tools, products, and services offered to provide customers with a curated vintage shopping experience collectively referred to as the “Services.”

Vintage Floof is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced within them, describe your rights and responsibilities when accessing or using the Services.

Please read these Terms of Service carefully. They contain important information regarding your legal rights, including warranty disclaimers and limitations of liability.

By visiting, interacting with, purchasing from, or otherwise using our Services, you agree to be bound by these Terms of Service and our Privacy Policy.

If you do not agree to these Terms of Service or our Privacy Policy, you should not access or use the Services.

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state of residence or that you have given your consent for any minor dependents to use the Services through devices that you own, purchase, or manage.

To access certain features of the Services or purchase our products, you may be asked to provide information including your name, email address, billing information, payment information, and shipping address.

You represent that all information you provide is accurate, current, and complete and that you have the necessary authority to provide it.

You are responsible for maintaining the confidentiality and security of any account credentials and for all activity associated with your account. You may not sell, transfer, assign, or license your account to another person.

Section 2 — Our Products

Vintage Floof specializes in vintage, antique, pre-owned, one-of-a-kind, and handmade items. Some handmade products may be created using antique, vintage, reclaimed, or previously owned textiles and materials.

Because of the age and history of these items, natural signs of wear may be present. These may include fading, discoloration, marks, repairs, loose threads, small holes, fabric variations, patina, tarnishing, surface wear, aging to hardware, and other imperfections consistent with age and previous use.

These characteristics are not necessarily considered defects. They are part of the individual history and nature of vintage and handmade goods.

We make every reasonable effort to:

Photograph each product accurately
Describe known flaws and condition concerns
Provide approximate garment or product measurements
Identify the estimated era, materials, brand, or construction when reasonably possible

Customers are responsible for reviewing all product photographs, descriptions, measurements, fit notes, condition notes, and our Vintage Condition Guide before purchasing.

Vintage sizing often differs significantly from modern sizing. Size labels and estimated size ranges are provided only as a general reference. Customers should compare the listed measurements with a similar garment or item they already own.

All measurements are approximate and may vary slightly based on the method of measurement, garment construction, fabric, and natural movement of the item.

Colors and product appearance may differ slightly from what appears on your screen because of lighting, photography, device displays, screen settings, and the age or texture of the material.

We do not guarantee that the appearance, fit, color, or quality of an item will meet a customer’s personal expectations beyond the product information reasonably provided in the listing.

Product descriptions, pricing, availability, and other information may be corrected or updated at any time. We reserve the right to discontinue a product or limit the quantity offered to any person or geographic area.

Most Vintage Floof products are one of a kind. Adding an item to your cart does not reserve or guarantee that item until checkout is completed and payment is successfully processed.

Section 3 — Orders and Final Sale Policy

When you place an order, you are submitting an offer to purchase from Vintage Floof.

We reserve the right to accept, decline, limit, or cancel an order for reasons including, but not limited to:

Product unavailability
Listing or pricing errors
Suspected fraud
Payment problems
Incorrect customer information
Unsupported shipping addresses
Circumstances that prevent us from completing the order

An order is not considered accepted until payment has been successfully processed and Vintage Floof has confirmed the order.

Please carefully review your cart, shipping information, measurements, photographs, condition notes, and product description before completing your purchase.

Because our items are generally one of a kind, vintage, antique, or handmade, all sales are final.

Vintage Floof does not accept returns or exchanges based on:

Fit
Sizing
Color preference
Change of mind
Buyer’s remorse
Expected age-related wear
Characteristics disclosed in the listing
Minor differences in measurements or screen appearance

Orders generally cannot be canceled or modified after they have been accepted and processed.

This final-sale policy does not prevent us from assisting with an order that arrives damaged in transit, contains the wrong item, or has a significant condition issue that was not disclosed in the listing.

All purchases remain subject to our Refund Policy.

Section 4 — Prices and Billing

Prices, discounts, promotions, and product availability are subject to change without notice.

The price charged will be the price displayed at the time the order is placed and will appear in the order confirmation.

Unless expressly stated otherwise, listed product prices do not include applicable taxes, shipping charges, handling fees, or other charges that may apply at checkout.

Prices offered through our website may differ from prices offered at in-person markets, events, pop-ups, or other selling platforms.

Promotions may be subject to separate conditions. When promotional terms conflict with these Terms of Service, the specific promotional terms will govern for that promotion.

You agree to provide accurate, complete, and current purchase, payment, billing, and account information.

You represent that:

The payment information you provide is accurate and complete.
You are authorized to use the payment method.
Charges incurred through your order will be honored by your payment provider.
You will pay all applicable product prices, shipping charges, and taxes.

We reserve the right to correct pricing errors and to cancel and refund orders placed using an incorrect price.

Section 5 — Shipping and Delivery

Vintage Floof currently ships only to eligible addresses within the United States.

We do not offer international shipping at this time.

Orders submitted with an unsupported international address may be declined or canceled and refunded.

Processing and delivery dates are estimates unless expressly stated otherwise. We cannot guarantee carrier delivery dates.

We are not responsible for shipping delays caused by:

Shipping carriers
Severe weather
Natural disasters
Service disruptions
Incorrect or incomplete addresses
Events outside our reasonable control

Customers are responsible for providing a complete and accurate shipping address.

Please contact us immediately at vintagefloof1920@gmail.com if you notice an error in your shipping information. We cannot guarantee that an address can be changed after an order has been processed or shipped.

If we cannot ship an order within the promised timeframe, we will contact the customer and provide any delay, cancellation, or refund options required by applicable law. Federal rules generally require online sellers to have a reasonable basis for stated shipping times and, when an order cannot ship as promised, to obtain the customer’s consent to the delay or provide a prompt refund.

Once a package has been transferred to the shipping carrier, delivery is handled by that carrier, subject to applicable law.

Customers should contact us promptly if an order:

Arrives damaged
Appears to have been lost in transit
Contains the wrong item
Is materially different from the item ordered

We may request photographs of the product, packaging, shipping label, or damage to help evaluate the issue or file a carrier claim.

Vintage Floof is not responsible for packages marked as delivered by the carrier that are subsequently lost or stolen. However, we will make reasonable efforts to help the customer locate the package or obtain available carrier information.

Section 6 — Intellectual Property

The Services and their contents are owned by or licensed to Vintage Floof and are protected by applicable intellectual property laws.

This includes, but is not limited to:

Vintage Floof’s name and branding
Logos
Product photography
Product descriptions
Website copy
Graphics
Videos
Artwork
Designs
Collection names
Website layout
Marketing content
Social media content

The Services may be used only for lawful, personal, and non-commercial purposes.

You may not reproduce, distribute, copy, modify, republish, display, download, transmit, sell, or commercially exploit any content from the Services without prior written permission from Vintage Floof.

Nothing in these Terms grants you a license or ownership interest in any trademark, copyright, design, photograph, content, or other intellectual property belonging to Vintage Floof, Shopify, or another party.

Vintage Floof’s names, logos, collection names, product names, designs, and slogans may not be used without prior written permission.

Shopify’s name, logo, products, designs, and services remain the property of Shopify. Other names, logos, and trademarks appearing through the Services belong to their respective owners.

Section 7 — Optional Tools

We may provide access to third-party tools or services that we do not monitor, control, or operate.

Access to these tools is provided on an “as is” and “as available” basis without warranties, representations, conditions, or endorsements.

Vintage Floof is not responsible for losses or damages arising from your use of optional third-party tools.

You are responsible for reviewing and agreeing to the applicable third party’s terms and policies before using those tools.

Any future features, tools, or resources added to the Services will also be subject to these Terms of Service.

Section 8 — Third-Party Links

The Services may contain links to websites, services, content, or functionality operated by third parties.

We are not responsible for reviewing or guaranteeing the accuracy, security, content, practices, products, or services of third-party websites.

When you leave our website or interact with a third-party service, you do so at your own discretion and risk.

Vintage Floof is not liable for losses, damages, or disputes related to third-party websites, products, services, resources, or content.

Please review the terms, privacy policies, and practices of third parties before completing a transaction or providing personal information.

Questions or complaints regarding third-party products or services should be directed to the applicable third party.

Section 9 — Relationship With Shopify

Vintage Floof is powered by Shopify, which enables us to provide the Services.

However, purchases made through the Vintage Floof store are made directly between the customer and Vintage Floof.

Shopify is not responsible for the sale, fulfillment, quality, condition, use, delivery, or performance of products sold by Vintage Floof.

To the extent permitted by law, you release Shopify and its affiliates from claims, damages, or liabilities arising from or relating to transactions made directly with Vintage Floof.

Section 11 — Reviews, Feedback, and Customer Content

If you submit a review, photograph, comment, suggestion, idea, message, feedback, or other content to Vintage Floof, you grant us a worldwide, perpetual, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, display, and promote that content in any medium.

This may include using customer reviews or submitted photographs on our website, social media, email marketing, advertising, or promotional materials.

You represent that:

You own or have permission to submit the content
The content does not violate another person’s rights
Any compensation or incentive connected to the content has been disclosed

We are not required to:

Keep submitted feedback confidential
Pay compensation for feedback

If we cancel an order after payment has been processed, the applicable payment will be refunded.

While we make reasonable efforts to provide accurate product descriptions and condition information, we do not guarantee that all information will be error-free, complete, or perfectly precise.

To the fullest extent permitted by law, the Services and products are provided on an “as is” and “as available” basis without express or implied warranties, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement.

Because Vintage Floof sells vintage, antique, pre-owned, and handmade items, customers acknowledge that products may display wear, aging, variation, fragility, repairs, alterations, or other characteristics associated with their age and history.

We do not guarantee that:

The Services will always be uninterrupted or error-free
A vintage product will have the same durability as a newly manufactured product
An estimated era, fabric, or historical description will be exact unless clearly documented
An item will fit based solely on a modern size label
Colors will appear exactly the same on every screen

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

Section 16 — Limitation of Liability

To the fullest extent permitted by law, Vintage Floof and its owners, employees, affiliates, agents, contractors, service providers, licensors, and partners will not be liable for indirect, incidental, punitive, special, exemplary, or consequential damages arising from:

Use of or inability to use the Services
Use, wear, care, alteration, or storage of a purchased product
Reliance on website content
Delays outside our reasonable control
Loss of data, revenue, profits, savings, or business opportunity
Errors or omissions in content
Third-party services or websites

Where liability cannot legally be excluded, our liability will be limited to the maximum extent permitted by law.

Some jurisdictions do not permit certain exclusions or limitations, so parts of this section may not apply to every customer.

To the extent permitted by law, you agree to indemnify, defend, and hold harmless Vintage Floof, Shopify, and their respective affiliates, owners, employees, agents, contractors, licensors, and service providers from third-party claims, damages, liabilities, losses, and reasonable legal expenses arising from:

Your misuse of the Services

We will provide reasonable notice of an indemnifiable claim when practical.

Any unenforceable portion will be severed without affecting the validity or enforceability of the remaining provisions.

Our failure to exercise or enforce a right under these Terms does not waive that right.

These Terms, together with our Refund Policy, Privacy Policy, Shipping Policy, Vintage Condition Guide, and any other policies posted through the Services, constitute the entire agreement between you and Vintage Floof concerning your use of the Services.

These Terms replace prior communications, proposals, or agreements relating to the same subject matter.

Section 20 — Assignment

You may not transfer, delegate, or assign your rights or obligations under these Terms without our prior written consent.

We may assign or transfer our rights and obligations in connection with a sale, restructuring, transfer, or operation of the business, subject to applicable law.

Section 21 — Governing Law

These Terms and any separate agreements through which Vintage Floof provides the Services will be governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Any legal proceeding relating to these Terms or the Services will be brought in a court with proper jurisdiction in the state where Vintage Floof is headquartered, unless applicable law requires otherwise.

Nothing in this section limits any consumer right that cannot legally be waived.
